California Civil Statute of Limitation Laws

In every state, there exist laws that limit the amount of time you have for filing a civil lawsuit against any business. These statutes are designed to create a sense of reason and fairness when filing lawsuits. Generally speaking, these laws are there to prevent people from hanging a potential lawsuit over someone's head for an extended period of time. Below is a short summary of civil statutes of limitations legislated by the state of California:

  • Personal injury lawsuits have a statute of limitation of two years.
  • Fraud lawsuits have a statute of limitation of three years.
  • Written contracts have a statute of limitation of four years.
  • Breach of oral contracts must be filed within two years.
  • Collection of debt on an account has a statute of limitation of four years.
  • Libel and slander lawsuits have a statute of limitation of one year.

These statutes of limitation are intended to ensure that the offending party of a lawsuit is made aware that he or she committed, or may be accused of committing, some level of wrongdoing against another party.
